TERMS AND CONDITIONS OF PARTICIPATION IN THE PROMOTION

1.- ORGANIZER

The company IBEROSTAR HOTELES Y APARTAMENTOS, S.L.U. (hereinafter "Iberostar"), with registered office at calle General Riera nº 154, Palma de Mallorca (07010), Balearic Islands, Spain, and Tax ID B-28049344, (hereinafter, “the Organizer" or "Iberostar"), is launching this raffle called "5 Nights at the Zanzibar" (hereinafter, "the promotion") to thank participants in the "Progressive Profiling" survey (hereinafter, "the Survey"), which is aimed at individuals interested in receiving personalized treatment and offers from Iberostar. The promotion will be carried out in accordance with the following terms and conditions.

 

2.- ACCEPTANCE OF THE TERMS AND PROMOTION OBJECTIVE

Acceptance of each and every one of the terms and conditions contained in this document (hereinafter, the "Terms" or the "Promotion") is a prerequisite for participation in the Promotion. Participation in the promotion implies unconditional acceptance of these Terms.

 

3.- PROMOTION DATES

Participation will take place between 8:00 a.m. (GMT+1) on September 15, 2026, and 11:59 p.m. (GMT+1) on March 31, 2027. 

Iberostar reserves the right to modify these Terms and the participation dates, extending or shortening them, or even to suspend the promotion, with the sole obligation of communicating such a decision prior to the end date.

4.- PARTICIPANT CONDITIONS OF THE PROMOTION

Participation in the Promotion is voluntary and free. Any person of legal age who has completed the Survey may participate.

Notwithstanding the above, Iberostar reserves the right to exclude or limit the countries to which this Promotion extends for operational or bureaucratic reasons.

 

5.- PARTICIPATION MECHANICS

Any person who wishes to participate in the Promotion must duly complete the Survey and request their participation by checking the corresponding box at the end of the form.

 

Participation in the Promotion requires being over 18 years of age and having completed the Survey. Each participant may enter using a single email address.

 

It is strictly forbidden for anyone with an employment relationship with the organizing company or the business Group to which it belongs to participate.

 

6.- PRIZE

Among all participants in the Promotion, a five-night stay for 2 people on an All-Inclusive basis at Iberostar Selection Zanzibar will be raffled.

Additional expenses that may be associated with the winner's enjoyment of the stay, as well as travel and transfer expenses of any kind, are not included in the prizes. Iberostar will not be responsible or liable for any travel.

The effective dates for enjoying the prize will be subject to availability at the Hotel. The prize winner must make the reservation at the Hotel with a minimum of three (3) months' notice. However, Iberostar will ultimately decide the dates and the hotel, and anyone who does not accept to enjoy the prize on the dates, place, and establishment determined by Iberostar will lose the right to the prize and their status as a winner. Once the prize reservation is confirmed, the dates for enjoying it cannot be modified. The maximum period to enjoy the prize is until March 31, 2028.

Any impossibility of benefiting from the prize will not give the winner the right to any compensation or alternative prize. The prizes are personal and non-transferable, cannot be exchanged for money, and no change, modification, compensation, or assignment to third parties is permitted. The prize may be declared void without a winner if the participants do not meet the conditions and requirements to be participants and winners in the promotion.

 

7.- RAFFLE

The winner will be chosen through a random drawing using the Marketing Cloud-Salesforce platform. The drawing will take place within 30 days following the end of the promotion.

 

8.- PRIZE COMMUNICATION TO WINNERS

The result of the Promotion will be notified by email. If the notice is sent to an incorrect email address, the winner will be disqualified. The winner will have 10 calendar days from the date of the notice to respond and confirm acceptance of the prize. The winner's right to claim the prize will expire if they do not claim the prize within this period. The Organizer reserves the right to disqualify any participant or winner who has provided false data or who violates the terms and conditions of the Promotion, without prejudice to any other action that may be appropriate under the law. In cases where the personal data or the address to which the prize was notified is incorrect, the winner does not claim the prize on time, or cannot enjoy it, the winner will be disqualified for non-compliance with the terms of this Promotion, and the prize will be void.

 

9.- TAXATION

Prizes from this promotion are subject to the provisions contained in Law 35/2006, of November 28, on Personal Income Tax and partial modification of the Laws on Corporate Tax, Non-Resident Income, and Wealth. They will also be subject to the provisions contained in Royal Decree 439/2007, of March 30, which approves the current Personal Income Tax Regulation; Royal Decree 1776/2004, of July 30, which approves the Non-Resident Income Tax Regulation; and Royal Legislative Decree 5/2004, of March 5, which approves the revised text of the Non-Resident Income Tax Law and other concordant provisions issued for their development.

In accordance with the aforementioned regulations, participants in this promotion are informed that prizes awarded for participation in games, contests, raffles, or random combinations linked to the sale or promotion of goods or services are subject to withholding or tax payments on account of personal income tax, as long as the prize value exceeds 300 euros. For clarification purposes, Iberostar will be obliged to make the corresponding personal income tax withholdings or payments on account when the prize value exceeds 300 euros or another amount in accordance with the applicable regulations at all times. If the prize value is less than that amount, Iberostar will not be obliged to make the withholdings or payments on account, although it will still be subject to formal information obligations to the Tax Agency.

Once the prize is accepted, it will generate an asset gain even if the winner does not enjoy it. The winner will be solely responsible for their obligations to the Tax Administration. Iberostar, after accepting the prize, is not responsible for whether the winner enjoys it or not, and is exempt from liability to any body, administration, or institution.

In relation to the above and in compliance with current tax regulations, the promoter will make the corresponding payment on account of the prize delivered if it is applicable based on the prize value and, in due course, will issue the appropriate certification at the request of the interested party to facilitate the participant/winner in fulfilling their tax obligations by having to include the asset gain consisting of the received prize in their Income Tax return, along with the rest of the income they receive, and from whose total tax liability the amount stated in the aforementioned payment on account certificate may be deducted as already paid, all as established by the aforementioned Law 35/2006, of November 28. Consequently, the promoter only assumes its legal obligation to make the payment on account when it is mandatory by law, with the taxpayer being responsible for fulfilling their respective tax obligations.

For these purposes, it is communicated that, regarding prizes in kind, the basis on which withholding will be practiced will be the declared market value increased by 20% as established by article 105.1 of the aforementioned Royal Decree 439/2007, of March 30, which approves the Personal Income Tax (IRPF) Regulation. The withholding percentage to be applied to the basis described above will depend on the tax residence of the winner, which must be determined, and if applicable, proven at the time of prize acceptance. Consequently, the withholding rate established in the current legislation at the time of acceptance will be applied, which as of the date of deposit of the terms is 19% for residents and for non-residents without a permanent establishment residing in the European Union or EEA (Norway and Iceland), and 24% for the rest of non-residents. Exceptionally, those non-residents who prove their protection under a Double Taxation Avoidance Treaty signed between Spain and their country of residence may be exempt from tax obligations in Spanish territory, in which case the provisions of said Treaty will apply.

Likewise, participants/winners are informed that on the day of their designation as such, they must confirm their personal data by showing their DNI or a valid identification document in Spain. In order for the payments on account mentioned in the preceding paragraphs to be made, the winner must in all cases sign a document justifying the receipt of the prize upon receiving it and provide the promoter with a photocopy of their DNI or a valid identification document in Spain. Otherwise, they would lose their right to receive or enjoy the prize.

The completion of the personal and tax data of the participants/winners necessary for the delivery of the prizes is legal and mandatory, so the absence or refusal to justify any of said data will result in the loss of the right to the prize obtained.

 

10.- APPLICABLE PRIVACY POLICY

In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) as well as by Organic Law 3/2018, of December 5, on Data Protection and Guarantee of Digital Rights (LOPDGDD), Iberostar informs that the data of individuals participating in the survey will be processed in accordance with the Iberostar Group customer and guest privacy policy, published on the Iberostar Group's Privacy Portal. The following information is provided regarding the processing of participants' and winners' data in the Promotion:

Controller: The data controller for the processing of participants' data in the Promotion for its management and control is Iberostar, whose details are at the beginning of this document. You can contact the Iberostar Group's Data Protection Officer at privacy.dpd@grupoiberostar.com. 

Processing Purposes: This data will be processed by Iberostar for the management and control of the promotion, with interested parties necessarily consenting to the processing and transfer of their data to the extent and under the conditions indicated in its terms.

Data Recipients: The personal data of the prize winners necessary for the proper enjoyment of the prizes will be communicated to the providers of the same (to the hotel). This may involve the international transfer of your personal information when these providers are located outside the European Economic Area. Other than this case, your data will not be transferred to third parties, except as required by legal obligation, with your prior consent, or to other companies in the Iberostar Group for internal administrative purposes.

Legal Basis: The legal basis for the processing of your data is your consent to participate in this promotion and the management of the corresponding legal relationship.

Retention Periods: We will retain your data for as long as necessary for the management of the promotion and, in any case, for the periods provided for in applicable legal provisions and the time necessary to address any potential liabilities arising from the processing.

Your Rights: You have the right to obtain confirmation as to whether or not we are processing your personal data and, if so, to access it.

You can also request that your data be rectified when it is inaccurate or that incomplete data be completed, as well as request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, you can request the limitation of the processing of your data. In such a case, we will only process the affected data for the formulation, exercise, or defense of claims or for the protection of the rights of other people. Under certain conditions and for reasons related to your particular situation, you can also object to the processing of your data. In this case, we will stop processing the data except for compelling legitimate reasons that prevail over your interests or rights and freedoms, or for the formulation, exercise, or defense of claims.

Likewise, and under certain conditions, you may request the portability of your data so that it can be transmitted to another data controller.

You can revoke the consent you have given for certain purposes, without affecting the legality of the processing based on the consent prior to its withdrawal.

You also have the right to file a complaint with a data protection authority. You can obtain more information about your rights and how to exercise them on the website of the Spanish Data Protection Agency.

To exercise your rights, you must send us a request to our Data Protection Officer at our address or at privacy.dpd@grupoiberostar.com. 

 

11.- OPERATION, COMMUNICATIONS, AND IDENTIFICATION

In addition to the causes expressly indicated in these Terms, Iberostar is not responsible for the malfunction of communication networks and/or errors that may arise when participating in the Promotion, interruptions, deletion, or non-recording of surveys and/or participations that are beyond its control.

Iberostar is not responsible for the consequences arising during the enjoyment of the prize, as well as for possible damages of any nature, personal, material, etc., both their own and those of third parties.

Nor will Iberostar be responsible if the winner of the prize, having been notified, does not check their email address, or if it is incorrect or incomplete, has been deleted, or is configured in a way that classifies messages or emails sent by Iberostar as blocked or spam, restricting, deleting, or not downloading them.

Iberostar may request any information or documentation from the winners to prove that they meet the conditions to be a participant and winner in the Promotion. In such a case, this information will be requested by email, and the winner will have a period of five (5) calendar days from the date the email is sent to provide it. If the winners do not provide the requested information or documentation to Iberostar's satisfaction, or if, after verification, they do not comply with any of the conditions of these Terms, they will be disqualified, and the prize will be void.

 

12.- LIABILITIES AND DISQUALIFICATION

Iberostar reserves the right to disqualify participants who act in an abusive and fraudulent manner, and any of the participants who deceive, conceal, or falsify participation data, or participate with different personal data or violate any of the conditions of these terms.

Iberostar also reserves the right to verify the identity, to check that they are not fictitious or created specifically to participate in the Promotion and/or to make multiple entries in promotions, with Iberostar being able, freely and at any suspicion or indication, to disqualify these participants who carry out these practices.

In the face of any fact or suspicion on the part of Iberostar or collaborating companies in the carrying out of the Promotion that a participant, or third parties, are altering any survey or participation by any procedure, they will be disqualified, even if they manage to participate or have obtained a prize, without Iberostar being obliged to notify said disqualification.

 

 13.- TIK TOK AND META SOCIAL NETWORKS 

The social networks TikTok and Meta do not sponsor, endorse, or administer this PROMOTION in any way, nor are they associated with it, fully exonerating TikTok and Meta from all liability. 

 

14.- GENERALE

The resolution of all issues that may arise or be raised regarding the interpretation of the Terms will be the exclusive competence of Iberostar.

Iberostar reserves the right to modify the content of these Terms, as well as the prize, in order to facilitate the greatest success of the Promotion and contribute to the dissemination of its spirit. The Terms and any possible modifications will be permanently published on the Iberostar Agents website.

Likewise, participation in a contest of this nature implies acceptance of the rules of the platform where it takes place.

15.- LEGISLATION AND JURISDICTION

These Promotion terms are governed by Spanish law. Participants agree that any controversy that may arise from the interpretation or execution of the terms will be expressly submitted to the jurisdiction of the Courts and/or Tribunals of Palma de Mallorca, waiving their own jurisdiction if they had one.
